The seminar on the analysis of administrative cases of new plant varieties was held at the CASS Institute of Law on the morning of October 11, 2023. At the seminar, presided over by Zhang Jingui, the head of the Research Coordination and International Cooperation Department of CASS Institute of Law, Associate Professor Li Judan, the person in charge of the project “Analysis of Administrative Cases of New Plant Varieties" of CASS Institute of Law, introduced the background, case sources, case analysis methodology, and the selection and analysis of specific cases of the project. After the introduction, leading experts in the fields of examination, reexamination, and judicial protection of the right to new plant varieties and related academic fields expressed their opinions on the related issues in the report on the project, fully confirmed the achievements of the project team, put forward opinions and suggestions for further improving the report, and carried out a heated discussion on such issues as the definition of the scope of protection of the right to plant varieties, the concurrence of infringement and breach of contract liability, the burden of proof and the counterfeiting of authorized varieties.
