The sixth session of the 2024 Shatan Youth Forum "Rule of Law and Chinese Modernization", sponsored by CASS Institute of Law and CASS Institute of International Law, was held in Beijing on June 25, 2024. At this session, Dr. Cai Rui, an assistant research fellow at the Civil Law Department of CASS Institute of Law, gave an academic lecture titled "How Public Law Affects the Effect of Contracts". The lecture was presided over by Professor Zhu Guangxin, deputy head of the Civil Law Department, and attended by more than 30 young researchers from CASS Institute of Law and CASS Institute of International Law.
In the lecture, Dr. Cai discussed the topic from three aspects: the historical evolution of contractual legal norms (norms that stipulate the invalidity of juristic acts that contravene compulsory provisions of law), the development of relevant precedents and theories, and issues that need to be further studied.
After the lecture, the participants and Dr. Cai exchanged opinions on such issues as the methods of identification of mandatory provisions, the evaluation of the effect of a contract in criminal-civil cases, the determination of the effect of the behavior of using community property to offer rewards to live-streamers, and the methods of judicial review of contracts that contravene ministerial rules.
