Asian Century: Cultural Regeneration of the Tao and Law

Hu Shuijun, Asian Century: Cultural Regeneration of the Tao and Law, Beijing: Social Science Academic Press, October 2021.

This is a book about jurisprudence and Chinese culture. At the end of the 20th century, human rights, market economy, and the rule of law had been integrated into jurisprudence in China one after another. In the 21st century, the linkage between and integration of jurisprudence and Chinese culture has also become a general trend. An examination of the path of development of Chinese culture reveals that a kind of jurisprudence based on the Tao is expected to re-emerge in China, in Asia, in the East, and even in the whole world, which, in the author's opinion, is suitable as a cultural symbol of the real arrival of the "Asian Century".

In this book, the author tries to grasp Chinese law from the three levels of the Tao, moral law, and positive law and, based on the principles of universal application contained in Chinese culture, stresses that, in the process of developing a secular system along the path of freedom, rights, and the rule of law in modern society, it is necessary to replenish the diluted free premise of the Tao and accept the corresponding moral practice, thereby forming a composite knowledge and practice structure of "Tao-Reason/Virtue-Jurisprudence/ Moral Education". The significance of this structure is that, while freedom and material supply are fully guaranteed by modern political, economic and legal systems, people have better conditions and a greater possibility to comprehend and practice the Tao and carry out moral practice. The author believes that this kind of modern regeneration of Chinese culture has world significance in the context of modernity.

This book attempts to clarify the fundamentals of Chinese culture and give a new exposition of the theory of “Chinese learning as substance and western learning as function”. As a pioneering work that reflects on jurisprudence from the perspective of Chinese culture, it is suitable for people from all walks of life, especially those in the political and legal circles, as well as lovers of Chinese culture.
