On the Legal Guarantee of "Chinese Path to Modernization"

Abstract: By comprehensively and systematically reviewing and summarizing the historical development of the "Chinese Path to Modernization" since the founding of the People's Republic of China from concept to system and finally being confirmed by policies, this paper discusses in detail the important role of the rule of law in confirming and guaranteeing the "Chinese Path to Modernization". Based on the above review and summarization and the five basic characteristics and nine essential requirements of the "Chinese Path to Modernization" proposed in the Report of the 20th National Congress of the Communist Party of China, the paper comprehensively expounds the dialectical relationship between the rule of law and the "Chinese Path to Modernization", pointing out that the legal guarantee of "Chinese Path to Modernization" is mainly to provide a specific and clear institutional guarantee for the "Chinese Path to Modernization" by confirming the status of the five basic characteristics of "Chinese Path to Modernization" and ensuring that the nine essential requirements are met. It emphasizes that the people must be taken as the center and the rule of law must beused in order to effectively promote the construction of the "Chinese Path to Modernization". In this process, it is necessary to give full play tothe role of the people as the masters of the country and guarantee the initiative, voice and decision-making power of all Chinese people through the rule of law.
