Abstract: The market economy must be a law-based economy. To promote the development of private economy, China must further strengthen the legal guarantee. Specifically, it must firstly carry out scientific legislation and improve the legal system for the development and growth of private economy as soon as possible; secondly, it must strictly enforce laws and continuously improve the law enforcement level for the development and growth of the private economy; thirdly, it must uphold impartial administration of justice and continuously strengthen the judicial guarantee for the development and growth of the private economy; and fourthly, it must promote the universal observance of law and comprehensively consolidate the rule-of-law foundation for the development and growth of the private economy.
