
Abstract:Real estate registration provides a legal basis for transaction security and the order of social property domination, serving as a fundamental law for the development of China’s market economy and the protection of people’s basic rights. As an interim law, the Interim Regulations on Real Estate Registration face problems such as low legislative rank, limited provisions, and institutional deficiencies, thus failing to meet the practical needs of real estate registration. Therefore, China should accelerate the formulation of the Real Estate Registration Law. In the legislative process, the Real Estate Registration Law should implement the principle of public notice of real rights, adhere to the principle of unification, position itself as a procedural law for registration, and strengthen the judicial characteristics of real estate registration. Guided by Xi Jinping Thought on the Rule of Law, the Real Estate Registration Law should integrate existing real estate registration systems, accelerate the process of electronic registration, strengthen the protection of personal information, expand the types of registrable rights, optimize registration liability for compensation, refine the principles of registration review, and establish a real estate registration system with a rigorous framework and sound institutions.
